Please read these Terms and Conditions carefully before requesting or booking a session with 1 Breath Photography. By contacting us, submitting a nomination, or participating in a session, you agree to the terms outlined below.

Nature of Our Services

1 Breath Photography offers gifted, pro bono portrait photography sessions to families and individuals across Southwestern Ontario. We do not sell products, prints, packages, or any other goods through this website or otherwise. All sessions are offered at the sole discretion of the photographer, based on availability, nominations, and self referrals.

Because sessions are offered as a gift rather than a paid service, we cannot guarantee that every request or nomination will result in a session, and there is no fee charged at any stage of the process.

Booking and Scheduling
Sessions are requested through nomination, self referral, phone, or email.
Scheduling depends on the photographer's availability and the nature of the request.
We reserve the right to decline, reschedule, or cancel a session at our discretion, including for reasons related to health, safety, or unforeseen circumstances.
Clients are asked to provide accurate and timely information to help us prepare for each session appropriately.
Client Responsibilities
Clients are responsible for ensuring that everyone appearing in a session, or their parent or legal guardian in the case of minors, consents to being photographed.
Clients should communicate any specific needs, sensitivities, or restrictions ahead of the session so we can prepare accordingly.
For sessions involving pets, clients are responsible for their pet's behaviour and safety during the session.
Image Ownership and Usage
1 Breath Photography retains copyright ownership of all photographs taken during a session.
Clients receive a personal use license to download, print, and share their photographs for non commercial purposes.
With client consent, images may be used by 1 Breath Photography for portfolio display, this website, social media, published works, or in partnership with charitable organizations.
Clients may opt out of public use of their images at any time by notifying us in writing, and we will make reasonable efforts to remove previously published images upon request.
Images may not be sold, altered, or used commercially by clients or third parties without written permission from 1 Breath Photography.
No Guarantee of Specific Outcomes

Photography is a creative and personal process. While every session is approached with care, compassion, and professionalism, we cannot guarantee specific poses, expressions, weather conditions, or the availability of any particular subject during a session, particularly during time sensitive or emotionally significant circumstances such as end of life sessions.

Testimonials

Clients who voluntarily submit testimonials or reviews grant 1 Breath Photography permission to display that feedback on this website or social media, along with the name provided, unless anonymity is requested.

Limitation of Liability

To the fullest extent permitted by law, 1 Breath Photography is not liable for any indirect, incidental, or consequential damages arising from participation in a session, including but not limited to dissatisfaction with the final images, delays, or technical equipment failure. Nothing in these terms limits any liability that cannot be excluded under applicable law.

Third Party Charitable Partners

Where a session is connected to a partnering charity or organization, that organization is responsible for its own policies and practices. 1 Breath Photography is not responsible for the actions of independent third party partners.

Governing Law

These Terms and Conditions are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Changes to These Terms

These Terms and Conditions may be updated from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
